How to Cite Advisory Opinions
Examples of appropriate Advisory Opinion cites are:
  • ERISA Advisory Opinion 75-81A (U.S. Dep't. of Labor, 1975),
    and;
  • ERISA Advisory Opinion 95-19A (U.S. Dep't. of Labor, 1995)
The format chosen by an analyst to reference a particular Advisory Opinion must take into account a number of factors. First, ERISA Advisory Opinions are issued by two agencies: the Pension and Welfare Benefits Administration (PWBA) and the Pension Benefit Guaranty Corporation (PBGC). Moreover, the name of one of these agencies changed after ERISA became law. Finally, the Department of Labor (DOL) issues guidance dealing with a number of areas in addition to ERISA.

Advisory Opinion cites must honor those concerns with which first-year law students are familiar, including respect for generally-recognized formats of citation, standardization, and a cite's value in assisting the reader in locating the cited reference.

A review of a popular guide to citation formats, court cases, DOL regulatory guidance, and Advisory Opinions citing other Advisory Opinions indicates that no generally-acceptable format of citation has evolved with respect to ERISA Advisory Opinions.
